Betty Perry will be back in court Thursday.
The 70-year-old, charged with failing to water her lawn and resisting arrest when an officer attempted to cite her for the landscaping violation, has a pre-trial conference at 11 a.m. in 4th District Court in Orem.
M. Paige Benjamin, Perry's attorney, said the hearing will be to set a date for Perry's trial. He said attempts to negotiate a plea agreement have failed.
Perry was arrested on July 6 when she refused to give Officer James Flygare, a member of the city's Neighborhood Preservation Unit, her name when he tried to write her up for having a dead lawn. In the ensuing scuffle with Flygare, Perry fell and injured her nose.

While the city initially apologized for her treatment, an investigation by the Utah Department of Public Safety cleared Flygare of any wrongdoing.
Also helping Perry is Gloria Allred, the high-powered Los Angeles attorney who represented the family of Nicole Brown Simpson. Allred, who attended Perry's first appearance in court, will not be at Thursday's hearing.
